Area transfer
Area transfer (arealoverføring) is the transfer of a defined area from one matrikkelenhet (cadastral unit) to another without creating a new bruksnummer. Both properties keep their matrikkelnummer. It is used when a landowner wants to transfer more than a boundary adjustment allows, but without splitting off a new property.
The legal basis is matrikkelloven § 15 (the Cadastre Act). An area transfer requires a cadastral survey, a municipal decision and registration in Grunnboken. Both registered owners involved must consent. The area transferred must be usable together with the receiving property in line with the zoning plan and the municipal master plan. The municipality can refuse the transfer if the use conflicts with the planning purpose or triggers a requirement for a building application. The treatment of mortgages and encumbrances is set out in § 15, first paragraph: the necessary declarations of mortgage release and any permits for the area must be in place before the transfer can be recorded in the matrikkel.
The distinction from a boundary adjustment matters in practice. A boundary adjustment is a minor change to an existing boundary and does not require registration of a new deed. An area transfer requires full registration in Grunnboken, with a deed, document duty (the rate is 2.5% of the sale price for the area transferred, set by the Storting under the Document Duty Act) and a registration fee. A boundary adjustment has strict maximum limits per transfer (5% of the smaller property's area, or 500 m² at most), while an area transfer is used when you want to transfer more than this. The distinction from subdivision is also important: with subdivision, an area is split off as a new property with its own bruksnummer, while with an area transfer the area becomes part of an existing property.
The process starts with a request for a cadastral survey to the municipality as the cadastral authority. The municipality carries out the survey, where the new boundary is measured and neighbouring properties are notified. A matrikkelbrev (cadastral certificate) is issued for both properties involved. The registered owners sign a deed for the area being transferred, and the documentation is sent to Kartverket for registration in Grunnboken. After an area transfer, the matrikkel is updated automatically when Kartverket receives the registration documents. The property area in the matrikkelbrev and in the Grunnboken record changes accordingly, and the mortgage basis for any loans is adjusted. Banks and insurance companies often need separate notice if mortgaged land is transferred out.
