Boligsalgsrapport

Boligsalgsrapport (housing sale report) is the historical term for an independent assessment of a home before a sale. Since 01/01/2022 the term has in practice been replaced by tilstandsrapport (technical condition report), which is the formal name of the report required by regulations under avhendingslova (the Norwegian Act on the sale of real property). Many estate agents, surveyors and sellers still use "boligsalgsrapport" as an everyday synonym, especially in marketing and in conversations with private customers. The underlying report is the same: a document from a certified building surveyor that describes the technical condition of the home, the maintenance needs and any deviations from normal standard.

Before the 2022 reform, several parallel report types existed with varying levels of quality: a short valuation, a "boligsalgsrapport" that was an extended visual assessment, and a "tilstandsrapport" that was the most thorough option. The reform brought the requirements together under one standardised tilstandsrapport that follows NS 3600 and the regulations under avhendingslova, with clear tilstandsgrader (condition grades TG0 to TG3, and TGiU) and minimum content covering 16 points. After the reform there is formally only one report type, but the old word lingers in the market.

For a home sale today this means that "boligsalgsrapport" and "tilstandsrapport" in practice refer to the same document, and that the buyer should expect the standardised template no matter what the seller or agent calls it. The content is what counts: was the report prepared by a certified building surveyor (certified by DNV or Norsk takst), does it follow the NS 3600 template, does it cover the minimum points from the regulations, and does it use the TG scale? If yes, it is a report that meets the requirements of avhendingslova, whatever its name.

The term "boligsalgsrapport" mainly has legal significance in transitional cases. Home sales where the agreement was made before 01/01/2022 are governed by the old rules, where "as is" clauses can still have limited effect and where a shorter boligsalgsrapport may have been accepted. For new sales the rules are stricter, and the difference matters commercially: matters that appear clearly in the report cannot later be invoked as a defect (avhendingslova section 3-10). That makes TG2 and TG3 remarks work both as price reductions and as a transfer of risk from seller to buyer.

For commercial property, neither "boligsalgsrapport" nor "tilstandsrapport" is used as a standardised term. Commercial sales are, as a rule, outside the consumer protection rules of avhendingslova, and equivalent assessments are made as a broader technical due diligence report that forms part of a larger set of documents around the transaction.

Are boligsalgsrapport and tilstandsrapport the same thing?

In practice yes, after 01/01/2022. The reform of avhendingslova brought all older report types together under the formal term tilstandsrapport, but "boligsalgsrapport" lives on as an everyday synonym among estate agents and sellers. What matters is that the report follows NS 3600 and uses the TG scale.

Why do two names still exist?

The terms were used in parallel for more than a decade before the 2022 reform, and they are embedded in marketing, estate agency tools and everyday speech. It makes sense to treat "boligsalgsrapport" as an older, more colloquial word for the same document. When you read about a "boligsalgsrapport" in a property listing today, it is practically always a modern tilstandsrapport that is meant.

Who writes the report?

A certified building surveyor. The certification is issued by DNV or Norsk takst, and the surveyor must act independently of the client. Under the industry norm, the surveyor can as a rule not repair the deviations they have pointed out themselves. That is what separates the report from a repair quote.

Do I need a boligsalgsrapport for a commercial sale?

No. The rules in avhendingslova about the tilstandsrapport apply to consumer purchases. For commercial property, the report is replaced by a broader technical due diligence report that forms part of the transaction documents, and that is often negotiated individually with the buyer.
