Jordsameie

A jordsameie is a plot of land held in sameie (co-ownership) between several properties. The term is used above all about outlying land shared between farms: grazing, forest, hunting, fishing and summer farming. What sets a jordsameie apart from an ordinary sameie is that the ownership share is tied to another property, not to a person. If you sell the farm, the share in the jordsameie goes with it. You cannot sell the share on its own, and you cannot sell the farm without it.

The legal basis is matrikkellova section 5, letter d, which places jordsameie as one of five matrikkelenhet types alongside grunneiendom (freehold land unit), festegrunn (leasehold land), anleggseiendom (construction property) and eierseksjon (owner section). A jordsameie is given its own gårdsnummer and bruksnummer when it is registered in the matrikkel. Many sameier are old, however, dating from long before a single property register existed, and a fair number are still unregistered. Outer boundaries, the group of owners and the share fractions can be unclear or documented only in land partition records (utskiftningsforretninger) from the 1800s and 1900s.

Disputes about existence, boundaries, share fractions or rights of use are decided by the land consolidation court (jordskifteretten) under the jordskiftelova of 2013. The land consolidation court can also carry out dissolution or a use arrangement (bruksordning) and make sure the sameie is registered in the matrikkel. Day-to-day management otherwise follows the general co-ownership rules in the sameigelova: the majority can decide on ordinary operation, while significant decisions such as sale, mortgaging or a change of use normally require the agreement of all the co-owners.

Jordsameie differs from realsameie in that a jordsameie always concerns land, typically outlying land, while a realsameie can cover other physical objects such as roads, wells or dams. For development projects that reach into historical outlying land, ownership and use often have to be clarified through jordskifte (land consolidation) before zoning work can start. An unclarified jordsameie in the middle of a plan boundary is one of the classic reasons a zoning process stalls.
