Översiktsplan
An översiktsplan is the overall land-use plan of a Swedish municipality. It shows the main features of how the whole municipal area is to be used, and it sets the direction for later planning and building cases, but it is not itself legally binding.
The legal basis is plan- och bygglagen (PBL) chapter 3. Under PBL 3 kap. 1 §, each of Sweden's 290 municipalities must have a current översiktsplan covering the whole municipal area, not just selected parts. Under 3 kap. 3 §, the plan must set out the main features of the intended use of land and water areas, with an accompanying map, and how the built environment is to be used, developed and preserved.
The sharpest difference from a Norwegian kommuneplan (the Norwegian municipal plan) lies in the legal effect itself. The land-use element of the kommuneplan is legally binding for new development and new measures in Norway. The Swedish översiktsplan is the opposite: PBL 3 kap. 2 § states plainly that "planen är inte bindande". Nobody can demand or be refused a bygglov or a detaljplan on the basis of what the översiktsplan says alone. Instead it works as a guiding, political policy document: courts use it as a central basis for decisions when a detaljplan or a bygglov is reviewed, and the municipality itself uses it to assess whether a planförslag is "förenlig med översiktsplanen" when choosing between standardförfarande and utökat förfarande for a new detaljplan.
The plan's currency must be maintained actively. Under PBL 3 kap. 23 §, kommunfullmäktige must adopt a planeringsstrategi no later than 24 months after each ordinary municipal election, in which fullmäktige takes a position on whether the översiktsplan is still current, in whole or in part. This aktualitetsprövning assesses whether the plan still gives guidance for land use, whether riksintressen are safeguarded, and whether the applicable miljökvalitetsnormer are followed. If no planeringsstrategi is adopted within the deadline, the whole plan stops counting as current (3 kap. 25 §), which in practice forces utökat förfarande for any detaljplan the plan would otherwise have supported.
Länsstyrelsen has a continuous control role: during the municipality's work on the plan, länsstyrelsen issues a granskningsyttrande (3 kap. 16 §) that assesses, among other things, whether the plan takes sufficient account of the riksintressen. This yttrande becomes the yardstick later, when the municipality decides whether a new detaljplan is "förenlig med översiktsplanen och länsstyrelsens granskningsyttrande" and can therefore be handled with the simpler standardförfarande.
Norway has a national copy of the kommuneplaner, while Sweden has no equivalent register for översiktsplaner: each of the 290 municipalities manages and publishes its own, with no shared point of access.
