Panteattest

A panteattest (mortgage certificate) is an extract from Grunnboken that shows the active encumbrances on a specific real property. Unlike a full land register extract, the panteattest shows only the encumbrance section: mortgages, easements, ground lease agreements, rights of first refusal, declarations of restriction on disposal and similar entries, without ownership history and deleted encumbrances. It is one of the most widely used extracts in residential sales and financing.

The panteattest is issued by Kartverket as the land registration authority under the Land Registration Act (tinglysingsloven). Professional users work with three different types of extract, depending on the purpose:

  • Land register extract: the whole land register page, with the registered owner, ownership shares and all active encumbrances.
  • Panteattest: active encumbrances only. Typically used by banks that have granted a mortgage loan, to confirm that the charge sits where they believe it sits, and that no new encumbrances have taken priority ahead of it.
  • Panteattest with history: also shows deleted encumbrances. Used for due diligence on older properties, to see what has previously rested on them.

You can order it through self-service at seeiendom.kartverket.no (free, uncertified extract), through Kartverket's paid service for a certified panteattest (with signature and stamp), or through subscription services used by banks, law firms and estate agents for ongoing lookups.

For a bank that is about to grant a mortgage loan, the panteattest is the operational document that confirms:

For an estate agent, the panteattest is part of the sales prospectus and must be presented together with the condition report and the purchase contract. For a developer considering an acquisition, the panteattest is the first step in due diligence. It reveals both financial burdens (attachment liens, judgment liens, statutory liens) and restrictions on use (negative easements, restrictions on disposal) that can stop a project or make it more expensive.

The panteattest shows each encumbrance with its registration date, day book number (sequence number), encumbrance type and a short text description. The detailed content of the document itself, for example the text of an easement agreement, is ordered separately from Kartverket. Bankruptcy proceedings and statutory liens for property tax or shared costs are shown as separate types.

A panteattest only has value while it is fresh. Many banks require an extract that is no more than 14 days old before payout, because new encumbrances can in theory be registered right up until the mortgage deed is entered. The practice follows from the priority rule in section 20 of tinglysingsloven: "først i tid, best i rett" (first in time, first in right).
