Pantedokument
A pantedokument (mortgage deed) is the written document that creates a charge over a property. Once it is registered in Grunnboken, the charge gains legal protection against creditors and later good-faith purchasers.
Under the Norwegian Mortgages Act (panteloven), the pantedokument must contain some core points: the chargor (owner), the chargee (the party holding the charge), the charge amount, the priority and an unambiguous identification of the charged property through the matrikkel number. The charge amount is the maximum sum the charge secures, including principal, interest and enforcement costs. Banks typically set the charge amount 10-20% higher than the loan to leave room for interest rate rises, default and future drawdowns within the same priority, without having to register again.
Norwegian banks use standardised mortgage deeds, often based on templates from Finans Norge. The standards let Kartverket process them automatically, and since 2017 banks, lawyers and estate agents have sent mortgage deeds electronically through Kartverket's electronic document reception service. An electronically submitted pantedokument is normally registered the same day, while paper submissions can take several weeks. Submission triggers a registration fee, but not document duty; the duty applies only to transfers of title under section 7 of the Document Duty Act.
A pantedokument is not the same as the loan it secures. The loan is a debt relationship between borrower and lender; the pantedokument is security for the claim. This means the same pantedokument can remain untouched while the loan agreement is refinanced, as long as the new loan agreement falls within the charge amount and the same chargee. When you change bank, the old pantedokument can either be transferred to the new bank (moved through a registered transport) or deleted and replaced with a new one. Transport is usually cheaper because it triggers only one registration fee, not a new fee plus a deletion fee.
Deleting a pantedokument requires consent from the chargee. Once the loan is repaid, the bank gives consent to deletion (or a partial release (pantefrafall) if only part of the property is freed), and the owner or agent registers the deletion. The charge does not lapse automatically when the loan is fully repaid; it must be deleted actively to disappear from Grunnboken. A forgotten pantedokument can sit there for decades and show up as an encumbrance in a later sale. In that case the original chargee must be traced, or, if the charge is more than 20 years old, it can be deleted under section 32a of the Land Registration Act when it is likely that the encumbrance has ceased.
For commercial property and larger home loans, a framework mortgage deed is often used, with a high charge amount and flexible credit underneath, where the borrower can draw down and repay within the same registered security. This reduces transaction costs when borrowing needs vary. The pantedokument appears in Grunnboken, the Grunnboken extract and the certificate of charges (panteattest) with date, amount and priority, and it is a key input to valuation and purchase analysis.
