Plan- och bygglagen (PBL)
Plan- och bygglagen, abbreviated PBL, is Sweden's principal act on land-use planning and building cases. It regulates everything from the municipality's overall land-use plans to the individual bygglov, in the same way that the plan- og bygningsloven does in Norway.
The act has SFS number 2010:900 and came into force on 02/05/2011, replacing the older plan- och bygglagen from 1987. From 01/12/2025, chapter 9 of the act was given a completely new structure (Lag 2025:974), but the other chapters are not affected by that reform. The chapter division that matters most for property work is: chapter 2 on public and private interests (the overall considerations that every plan and every decision must be weighed against), chapter 3 on the oversiktsplan, chapter 4 on zoning through detaljplan and area regulations, chapter 5 on the process itself for drawing up detaljplaner and area regulations, chapter 9 on lov och förhandsbesked (bygglov and similar), chapter 10 on carrying out building, demolition and ground works (startbesked and slutbesked), and chapter 11 on supervision, access, intervention and sanctions.
The act is built on the municipal planning monopoly, set out in chapter 1, section 2: "Det är en kommunal angelägenhet att planlägga användningen av mark och vatten enligt denna lag." This means that it is the municipality, not the state or a private developer, that alone decides whether, where, how and when building takes place within the municipality's borders. In practice it is the byggnadsnämnden that administers the act locally, while Boverket is the national authority for PBL. Two regulations and rule sets are closely tied to the act itself without being part of it. Plan- och byggförordningen (PBF) supplements PBL with more detailed provisions, including which measures require anmälan instead of a bygglov, and the calculation of byggsanktionsavgifter. Boverkets byggregler (BBR) are the technical requirements for the building itself: load-bearing capacity, fire safety, energy use, accessibility and similar, laid down by Boverket under PBL and plan- och byggförordningen.
Plan- och bygglagen corresponds to the Norwegian plan- og bygningsloven, and the municipal planning monopoly is identical in basic structure in both countries. The clearest difference lies in who owns the technical building requirements. In Norway, Direktoratet for byggkvalitet (DiBK) administers TEK17, the technical regulation under the plan- og bygningsloven, as a separate directorate under Kommunal- og distriktsdepartementet. In Sweden, the same agency, Boverket, is both the national planning authority for PBL and the administrator of the technical building rules in BBR. Boverket therefore covers a broader field than its Norwegian counterpart DiBK does alone; the closest Norwegian parallel to Boverket's full role is a combination of DiBK and parts of what in Norway sits with the ministry.
