Planvask

Planvask ("plan cleaning") is a systematic review in which a municipality tidies up old land use plans and passes formal decisions to amend or repeal zoning plans that are outdated, little used or at odds with current policy. The aim is to reduce the number of overlapping and obsolete plans, so that it becomes clearer what actually applies to an area. The term is not a separate statutory process, but a collective name for this clean-up work.

The legal basis for amending or repealing a plan lies in plan- og bygningsloven (the Planning and Building Act). For the repeal and amendment of a zoning plan, plan- og bygningsloven § 12-14 as a starting point applies the same rules as for making a new plan: proposal, public consultation and a decision by the municipal council. Minor changes can be made through a lighter process without a new consultation. In practice, the municipality is free to repeal or amend older plans; this is decided by planning expertise and local political judgement.

The need arises because many municipalities have a large number of zoning plans that have built up over several decades. Older plans may be based on an earlier version of the act (before PBL 2008), use land use categories that no longer exist, or grant building rights that conflict with the land use element of the municipal master plan. When several plans overlap the same area, it becomes unclear which one governs, and unresolved development purposes can stand in the way of densification, protection of nature or updated climate adaptation. A planvask goes through the portfolio, assesses which plans should be kept, amended or repealed, and clears away those that no longer serve their purpose.

The work is often linked to a revision of the municipal master plan. The municipality maps the plans in force, prioritises which ones to deal with, and passes decisions on repeal or amendment. Statsforvalteren (the county governor) has an advisory role and can raise an objection where national or regional interests are affected. In practice, planvask is resource intensive, and current legislation provides little automatic coordination between the adoption of new plans and the repeal of old ones. Kommunal- og distriktsdepartementet (the Ministry of Local Government and Regional Development) has therefore worked on guidance for how municipalities should carry out such a clean-up.

For a landowner or developer, the consequence matters: if an older zoning plan is repealed, the building rights and framework it contained fall away, and the area is instead governed by the land use element of the municipal master plan or by any new plan. A project based on an old plan may therefore have to apply for a dispensation or trigger a requirement for a new zoning plan. So always check whether the plan you are relying on is still in force.
